UPDATE: Athens man charged with child porn possession

In September, a Wal-Mart customer reported seeing a man photographing a young child in the men’s restroom at the store on U.S. 72, an official said Wednesday.

The customer told a store manager he walked into the restroom and saw the man holding a cellphone over one of the stalls like he was taking a picture or video, Athens Police Chief Floyd Johnson said. The customer said he told the man to stop what he was doing, and the man ran. The customer identified the man, who was still in the store.

Police Officer Mac McWhorter confronted the man — identified as Bradley Eugene Kelley, 32, of 602 10th St., Athens — who was a vendor at the store, court records show.

In his report filed in Limestone County District Court, McWhorter said although Kelley was evasive in answering questions, he allowed the officer to look at his cellphone. When McWhorter opened what he believed was a pornographic video on the phone, Kelley tried to grab the phone from him, according to the report. McWhorter took the phone into evidence, Johnson said.

Sgt. Brett Constable obtained a search warrant for Kelley’s phone and had its contents analyzed. The search produced several nude images of what appeared to be children, Johnson said.

On Tuesday, investigators executed a search warrant at Kelley’s home and seized a computer and other evidence to be analyzed for any other evidence, Johnson said. Investigators also arrested Kelley on a warrant for possession of obscene material involving a child under age 17, specifically the images found on the cellphone as a result of the first search warrant.

Kelley was booked at the Police Department and transferred to the Limestone County Jail, where he was released after posting bail of $5,000, records show.

The investigation into the case is continuing, Johnson said.

“If other charges are made it may be when we present the case to a grand jury,” he told The News Courier. “We will have to look at all the evidence when we get everything back.”

Kelley was barred from Wal-Mart, according to McWhorter’s report.
