Man found not guilty in 2015 shooting of Florence man
NAVARRE, Fla. (AP) — A Florida man has been found not guilty in the shooting of a 22-year-old University of Alabama student.
News outlets report 60-year-old John Marshall Fitzgerald was found not guilty by reason of self-defense Thursday in the October 2015 shooting of Nelson Rivers Starkey.
The incident occurred at Fitzgerald’s Navarre home while he was being visited by his nephew and Starkey.
Fitzgerald testified that an argument broke out between him and Starkey and he demanded Starkey and his nephew leave the house. When they didn’t leave, Fitzgerald retrieved a pistol and threatened them.
A struggle allegedly ensued between Fitzgerald and Starkey when Starkey wouldn’t leave. Fitzgerald then shot Starkey in the leg, elbow and head.
Fitzgerald faced several charges, including second-degree attempted murder. He was cleared by the jury on all charges.
Starkey is being treated at a Florence, Alabama hospital.
