No charges have been filed against a man accused of shooting another man late Sunday on Sixth Avenue in Athens, an official said.

Athens Police Capt. Trevor Harris said witnesses have identified the shooter as Angel Gabriel Delgado Hernandez. Harris said Hernandez fired one round into his brother-in-law during a dispute.

The victim, a 36-year-old Hispanic male, was struck once in the stomach. The victim went to Huntsville Hospital by car.

Huntsville police initiated an investigation but notified local authorities when they found out the shooting took place in Athens.

Harris said investigators are continuing to investigate what led up to the incident. He added the case would be presented to a grand jury, which would decide if Hernandez should be formal charged with a crime.
