The family of a boy fatally shot at a Madison Middle School in 2010 is suing Madison school officials and others for failing to protect him from a problem student.
The civil suit, filed Thursday in Madison County, claims school officials — including the school board, Superintendent Dee Fowler and Principal Robbie Smith —failed to protect Todd Brown from Hammad Memon, who had a history of behavioral issues. The suit also names Memon and his parents. The family claims Memon should not have been transferred to Discovery Middle School because of a history of bad behavior of which Fowler and Smith were aware.
Memon shot Brown in the head with a handgun between classes at Discovery Middle School on Feb. 5, 2010. He has been free on bond since Oct. 18, 2010, and will be tried as an adult in June.
