Jones’ residency questioned

Where does Limestone County’s newly elected District Attorney Brian C.T. Jones live?
On campaign records, Jones lists his address as 22349 Cantera Drive in Athens. However, Madison County tax-collector records show Brian C.T. Jones lives at 1503 Mountainbrook Drive S.E. in Huntsville.
In 2005, Jones applied for and was granted a homestead exemption for the Huntsville address. Limestone License Commissioner Brian Patterson said once it (the exemption) is applied, it is automatically renewed for every year a person owns the house. A spokeswoman in the Madison County Tax Collector’s Office said Jones is listed as the owner of that property for tax year 2011.
According to the Code of Alabama 1975, 40-9-19 through 40-9-21.1, “A homestead exemption is a tax break a property owner may be entitled to if he or she owns a single-family residence and occupies it as his/her primary residence of the tax year for which the property owner is applying.”
The address listed on Jones’ campaign records — 22349 Cantera Drive in Athens — is listed as belonging to Jones’ wife, according to Limestone County tax records. The records show Jones’ wife bought the property in 2006 as Kandye H. Jean and she was granted a homestead exemption on that address. She and Jones have since been married.
Alabama Code 40-9-19, Title 40, on Revenue and Taxation-Homesteads states: “In no case shall the exemption herein made apply to more than one person, head of the family….”
For Jones to conceivably claim a homestead exemption on the Huntsville property he would have to sleep there at night and, in that case, he would not be considered a Limestone County resident and eligible for election to public office here.
Jones did not return a phone message by press time.
Jones defeated Democratic incumbent Kristi Valls in Tuesday’s General Election, 13,231 votes to 12,533.
