UPDATE: Trial set for woman accused in murder-for-hire plot

A Dec. 12 trial is tentatively set for a Limestone County woman accused in a murder-for-hire plot against the father of her child, court records show.

Misty Carol Malinowski, 37, of 111 Bent Saddle St., Harvest, was arrested in May on a warrant charging her with conspiracy to commit murder, according to Limestone County Circuit Court records. She is accused of trying to hire someone to kill Allen Thomas Wampler, records show.

She has pleaded not guilty to the charge.

Athens attorney Dan Totten is her court-appointed attorney.

Limestone County Sheriff’s Investigator Johnny Morell told The News Courier Malinowski, who lived in Morgan County, was worried about losing custody of her child, who was in the custody of Wampler, who lived in Limestone County. Through telephone and text messages, Malinowski tried to hire a man to kill Wampler, the investigator said. The man contacted Wampler to “give him a head’s up” about the plot, the investigator said. 

Wampler then reported the plot to authorities, Morell said.

“We pulled phone records and found text messages, and it exploded into a case,” the investigator said. “It was a stupid decision on her part.”

The Limestone County grand jury indicted Malinowski on the charge April 7.

She has been free on $25,000 bond since her arrest in May.

A Nov. 30 plea docket is scheduled before Circuit Judge Chadwick Wise, at which time Malinowski could enter a guilty plea in exchange for a lesser sentence. Her trial could be rescheduled because a murder trial is scheduled in Circuit Court the same week.
