GRAND JURY: Athens man accused of strangling wife among 108 indicted

An Athens man accused of strangling his wife, who is deaf and mute, at Swan Creek fishing area is among 108 people recently indicted by the Limestone County grand jury.

Sylvester Smith Jr., 29, of 20005 Yarbrough Road, was initially charged with domestic violence (strangulation/suffocation) May 11 and formally charged by the grand jury Aug. 11, court records show.

According to a report filed in Limestone County District Court by Limestone County Sheriff’s Deputy Terry Johnson, he was dispatched to Madison Hospital emergency room on May 11 to investigate a possible domestic violence situation that occurred in Limestone County. He arrived at the hospital and determined both Smith and his wife, Kristin, were deaf and had speech impairments. He asked Kristin to write down what occurred. She wrote that she and Sylvester were near the Swan Creek fishing area when they became involved in an argument. She wrote that she tried to run away but Sylvester caught her, began strangling her and drug her to their car.

Johnson noticed marks around Kristin’s neck and marks and bruising on her left arm as well as marks, bruising and fingernail marks on her left thigh.

The deputy found Sylvester asleep in their car in the hospital parking lot and placed him under arrest for domestic violence (strangulation). He is one of 108 people recently indicted by the Limestone County grand jury on one or more charges. Members of the Limestone County District Attorney’s Office presented evidence to the grand jury and jurors made a determination as to whether the person should be formally charged with a crime.
