The estate of a Limestone County woman murdered by her husband amid their divorce is suing his estate for $10 million, court records show.
Barry Delano Phillips of Athens, the son and personal representative of the estate of the late Linda Baugher Perry, is suing Jackie J. Perry II and Lisa Renae Swindall, the son and daughter of the late Jackie J. Perry, in their capacity as co-personal respresentatives of their father’s estate, according to the complaint filed Jan. 12 in Limestone County Circuit Court.
Records show Linda Perry, 72, was seeking a divorce from Jackie Perry, 73, in Limestone County, citing irreconcilable differences. Linda had gone to the couple’s home on Pepper Road in the East Limestone community the morning of Jan. 6 to retrieve some belongings when Jackie fatally shot her and then himself, according to the Limestone County Sheriff’s Department.
Some of Linda’s family members, who had arrived to help Linda remove some items, called 911 to report hearing gunshots inside the residence, Deputy Stephen Young, public information officer for the Sheriff’s Department, said the day of the shootings. When deputies arrived at the residence shortly after 10 a.m., Linda and Jackie were found dead of gunshot wounds, Young said.
Phillips, who has asked that the case be tried before a jury, is seeking $10 million in punitive damages plus interest and costs for the wrongful death of his mother.
Attorneys James Corder and Mitchell Shelly of Alexander, Corder & Shelly P.C. of Athens are representing Phillips.
