The Limestone County District Attorney will seek input from a state toxicologist in a case involving a Decatur physical education teacher and coach involved in a fatal car wreck in February.
Limestone County District Attorney Kristi Valls said Monday she would seek an interpretation of the evidence from the state toxicologist in order to answer questions posed by a grand jury when it hears the case in the future.
Grand jurors will decide if there is adequate evidence to charge driver Rusty McIntyre, 26, of Decatur, in connection with the wreck.
A police report shows McIntyre was heading west on 20 just after 6 a.m. Feb. 1 when his car crossed the median and struck the driver’s side of an eastbound car driven by Anthony Cheek Jr., 51, of Longview Drive S.W., who was declared dead at the scene. Cheek was heading to work at Lockheed Martin in Huntsville. McIntyre was ejected from his vehicle and taken to Huntsville Hospital. He is a physical education teacher at Somerville Road Elementary School and assistant baseball coach at Decatur High School.
Although Decatur Police investigated the wreck on Alabama 20, it occurred in a Decatur-annexed portion of Limestone County so the case went to the Limestone County District Attorney’s Office.
