The father of the man accused of attempted murder in last week’s shooting of a motorcyclist on U.S. 72 East said Tuesday his son suffers from a mental disability.
Elvie McGlawn of Whiteville, Tenn., shared the information with The News Courier following a preliminary hearing in Limestone County District Court for his 20-year-old son, Noah.
Then the elder McGlawn said he was advised not to comment further.
“I will say only that we can do all things through Christ who strengthens us,” he said, referring to a verse from Philippians.
Noah, also of Whiteville, is charged with attempted murder and shooting into an occupied vehicle in connection with the Sept. 10 random shooting of Brandon Matlock, 23, of Athens.
During Tuesday’s hearing, Noah’s father asked Limestone County District Judge Jerry Batts to appoint an attorney for his son. He specifically asked Batts to appoint former Limestone County District Attorney Kristi Valls, now in private practice. Batts said the court simply goes down a list when appointing attorneys for those who cannot afford to hire one, and then appointed local defense attorney Dan Totten.
Noah appeared at the hearing cuffed and shackled and wearing a black and white jail uniform. He was expressionless and frequently looked down through the proceeding. Because Noah had not yet consulted with an attorney, Batts rescheduled the preliminary hearing, which is conducted to determine whether there is probable cause to present the case to a grand jury. The hearing was reset for 1:30 p.m. Tuesday, Oct. 2.
Noah has remained in jail since the incident. During a previous bail hearing, Circuit Judge James Woodroof Jr. declined to set bail for the accused, District Attorney Brian Jones told The News Courier. A judge may deny a request for bail if he or she believes the defendant will harm him or herself or others or if the defendant may be a flight risk.
Noah told Athens Police investigators a few hours after the shooting that he was angry with his father, who wanted him to go to trade school, and “just felt like shooting someone.”
Matlock underwent surgery at Huntsville Hospital and is now recovering from bullet wounds to the right shoulder and lower, right back.
